Terms of Service & Online Liquor Sales Terms

Welcome to Dogrock.

These Terms of Service apply when you visit dogrock.com.au, purchase wine or other products from us, or otherwise use our online store.

Dogrock Winery is an independent winery in Crowlands, Victoria. Our online store is powered by Shopify.

By using our website or placing an order with Dogrock, you agree to these Terms.

Because we sell wine, there are also some important legal responsibilities that apply to both us and you. We've tried to explain them as clearly as possible below.


1. You must be 18+

This one's important.

You must be 18 years of age or older to purchase alcohol from Dogrock.

By purchasing wine through our website, you confirm that you are at least 18 years old and legally entitled to purchase alcohol.

We may request information or identification reasonably necessary to verify your age.

For first-time online customers, you will be required to confirm that you are 18 or older when ordering.

It is an offence to obtain alcohol on behalf of a person under 18, and we will not knowingly sell or supply alcohol to a minor.

We reserve the right to refuse or cancel an order if we reasonably believe that the purchaser or intended recipient is under 18 or that the purchase may otherwise breach liquor licensing laws.


2. Our liquor licence

Dogrock Winery operates under a Victorian liquor licence.

Victorian Liquor Licence No.: 32804125

Our sale and supply of alcohol is subject to our licence conditions and the Liquor Control Reform Act 1998 (Vic).

WARNING

Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under 18 years (penalty exceeds $24,000) and for a person under 18 years to purchase or receive alcohol (penalty exceeds $1,000).

Our liquor licence number is also displayed on our website and, where required, advertising or promotional material relating to alcohol delivery or pickup.


3. Ordering wine from Dogrock

When you place an order, you are making an offer to purchase the products in your order subject to these Terms.

Receiving an order confirmation doesn't necessarily mean we've accepted the order.

We may decline or cancel an order where, for example:

  • Wine is unavailable or there has been a stock error;

  • Pricing or product information contains an obvious error;

  • We cannot deliver to the address supplied;

  • Payment cannot be processed;

  • We cannot reasonably verify that liquor licensing requirements will be met;

  • We suspect an order is fraudulent;

  • We reasonably believe alcohol may be supplied to a minor or intoxicated person; or

  • Accepting or fulfilling the order would breach our liquor licence or applicable law.

If we've taken payment for an order that we subsequently cannot accept, we'll arrange an appropriate refund.


4. Age verification & delivery

Selling wine online comes with responsibilities that continue all the way to your front door.

When required by law, our delivery partners may ask the person receiving an order to provide an acceptable proof-of-age document confirming they are 18 or older.

Please don't be offended if you're asked for ID — our delivery partners are doing exactly what they're supposed to do.

First Dogrock orders

For a first-time online order that isn't a gift, you must confirm that you are 18 years or older.

Where required under Victorian liquor laws, the delivery must be received by the person who placed the order and the delivery person must verify that person's age using an acceptable evidence-of-age document.

If the required person isn't available or suitable proof of age can't be provided, the wine may not be delivered.

Additional delivery charges may apply if another delivery attempt is required, except where this would be inconsistent with your rights under Australian Consumer Law.


5. Sending Dogrock as a gift

Wine makes a pretty good present. There are just a couple of extra rules when alcohol is involved.

If you purchase wine as a gift, you confirm that:

  • You are 18 years of age or older;

  • The intended recipient is 18 years of age or older; and

  • The recipient's name and delivery address you provide are accurate.

We may provide those details to our delivery partner for the purpose of completing the delivery and complying with liquor laws.

The person accepting the delivery may be required to provide acceptable proof that they are 18 or older.

We won't knowingly deliver a gift of alcohol to a minor.


6. Authority to leave & unattended deliveries

Whether wine can be left unattended depends on the circumstances of the order and applicable liquor laws.

Same-day orders

Alcohol ordered for delivery on the same day cannot be left unattended.

There must be an eligible person present to receive the delivery.

Subsequent orders

For subsequent orders, where permitted by law, we may ask you to provide instructions about where the wine may be left if you're not home.

Any authority-to-leave instruction is subject to liquor licensing requirements and the delivery provider being satisfied that it is lawful and appropriate to leave the order.

An authority to leave doesn't override liquor laws.

If the delivery driver cannot lawfully or safely complete the delivery, the wine will not be left.


7. We don't deliver alcohol to minors

Dogrock will not knowingly supply or deliver alcohol to anyone under 18.

Our delivery partners may refuse delivery where:

  • The recipient appears to be under 18 and cannot provide acceptable proof of age;

  • The required recipient isn't present;

  • There is reason to believe the alcohol is being supplied to a minor; or

  • Completing the delivery would otherwise breach liquor laws.

Please don't ask a person under 18 to accept a wine delivery on your behalf.


8. Intoxicated recipients

Wine should be enjoyed responsibly.

Alcohol must not be supplied to an intoxicated person where prohibited by law.

A delivery may therefore be refused if the delivery person reasonably believes the recipient is intoxicated or where supplying the alcohol would otherwise be unlawful.

A refused delivery in these circumstances doesn't require Dogrock or the delivery provider to leave the wine at the address.

We reserve the right to deal with redelivery, cancellation and associated costs in accordance with applicable law and the circumstances of the order.


9. Delivery times

Orders can be placed through our website at any time, but alcohol can only be packed, dispatched, delivered or otherwise supplied during times permitted by our liquor licence and applicable liquor laws.

In Victoria, alcohol supplied in response to an off-premises order must not be delivered after 11pm.

Our actual delivery services will generally operate within much narrower windows determined by Dogrock and our delivery partners.

Estimated delivery dates and times are estimates rather than guarantees unless we expressly tell you otherwise.


10. Interstate orders

We love sending Dogrock beyond the Pyrenees.

We may accept orders for delivery to Australian states and territories outside Victoria where we are legally permitted and practically able to do so.

Alcohol laws and delivery requirements vary across Australia.

By ordering from another Australian state or territory, you acknowledge that your order may be subject to additional restrictions applying at the delivery destination, including requirements relating to:

  • Age verification;

  • Delivery times;

  • Who may receive the order;

  • Unattended deliveries;

  • Restricted locations or communities; and

  • Quantity or other alcohol restrictions.

We may refuse, limit, hold or cancel an order where necessary to comply with the laws applying at the delivery destination.

We do not deliver alcohol to locations where its sale, possession or delivery is prohibited or restricted in a way that prevents us from lawfully completing the order.


11. Responsible service of alcohol

Dogrock supports the responsible enjoyment of wine.

We reserve the right to refuse a sale, cancel an order or prevent a delivery where we reasonably believe completing the transaction would be unlawful or inconsistent with our responsible service obligations.

Our staff and delivery partners must comply with applicable liquor laws, including requirements relating to minors and intoxicated persons.

12. Prices & payment

Prices displayed on our Australian website are in Australian dollars (AUD) and include GST where applicable, unless stated otherwise.

Delivery charges, where applicable, will be shown during checkout.

Payment must be successfully processed before we fulfil an online order.

While we do our best to ensure pricing is accurate, occasionally mistakes happen. If there is an obvious pricing or product error, we may contact you before accepting or fulfilling the order.


13. Product availability

Dogrock is a small winery, which means some wines are genuinely limited.

Vintages sell out, releases change and occasionally our online stock count may not perfectly match what's sitting in the winery.

All products are subject to availability.

If something you've ordered is unavailable, we'll contact you and may offer an alternative, store credit or refund as appropriate. We won't substitute another wine without your agreement.


14. Wine is a natural product

Part of what we love about wine is that every vintage is a little different.

Bottle variation can occur, and photographs displayed on our website are intended to represent the relevant wine as accurately as reasonably possible.

Vintage, packaging, labels and closures may occasionally change. Where the vintage is material to the product being purchased, we'll endeavour to identify it clearly.

Nothing in this section limits your rights if a wine is faulty or doesn't comply with a consumer guarantee under Australian Consumer Law.


15. Returns, damaged wine & refunds

Our Returns & Refunds Policy forms part of these Terms.

If wine arrives damaged, incorrect or you believe there's a genuine fault, please contact us at hello@dogrock.com.au with your order details, a description of the problem and photographs where relevant.

Please don't send wine back to Dogrock without contacting us first.

Our Returns & Refunds Policy explains how we handle damaged or faulty wine, replacements, store credits and refunds.

Nothing in these Terms limits the rights or remedies you may have under the Australian Consumer Law.


16. Australian Consumer Law

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where these Terms are inconsistent with a right you have under Australian Consumer Law, your statutory rights apply.


17. Wine Club & subscriptions

If you join a Dogrock Wine Club, subscription or recurring wine offering, additional terms may apply to that membership.

We'll make any applicable frequency, minimum commitment, pricing, payment and cancellation arrangements available when you join.

Where there's an inconsistency between these Terms and specific Wine Club terms, the Wine Club terms will apply to the extent of that inconsistency, subject always to applicable law.


18. Promotions & discount codes

From time to time we may offer promotions, special releases, discount codes or other offers.

Unless otherwise stated:

  • Promotions cannot be combined;

  • Discount codes have no cash value;

  • Offers are subject to availability;

  • Eligibility conditions may apply; and

  • We may correct, suspend or withdraw an offer where there has been an error, misuse or circumstances outside our reasonable control.

Any specific conditions published with a promotion also apply.

Nothing in a promotion excludes your rights under Australian Consumer Law.


19. Website content

The content on our website — including photographs, copy, branding, graphics, logos and other material — belongs to Dogrock or is used by us with permission.

You may browse and use our website for personal, non-commercial purposes.

You must not reproduce, republish, commercially exploit or misuse our content without permission except where permitted by law.


20. Using our website

Please don't use the Dogrock website:

  • For unlawful or fraudulent purposes;

  • To interfere with the operation or security of the website;

  • To introduce malicious software or harmful code;

  • To attempt unauthorised access to our systems or customer information;

  • To impersonate another person; or

  • In a way that infringes another person's rights.

We may restrict access to the website where reasonably necessary to protect Dogrock, our customers or our systems.


21. Shopify & third-party services

Our online store is powered by Shopify.

We also use third-party providers to help us process payments, deliver orders and operate our website and business.

Your use of some third-party services may also be subject to their own terms and privacy practices.

Our handling of personal information is explained in our Privacy Policy.


22. Privacy

When you purchase from Dogrock or otherwise interact with us, we collect and use personal information as described in our Privacy Policy.

This includes information required to process orders, arrange deliveries, communicate with you and meet our liquor licensing and legal obligations.


23. Liability

To the maximum extent permitted by law, Dogrock isn't responsible for losses that weren't reasonably foreseeable or that result from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies available under Australian Consumer Law.


24. Changes to these Terms

We may update these Terms from time to time to reflect changes to Dogrock, our website, delivery arrangements, service providers or legal and regulatory requirements.

The current version will be published on our website together with the date it was last updated.

Terms applying to an order will generally be those in effect when that order was placed, except where the law requires otherwise.


25. Governing law

These Terms are governed by the laws of Victoria, Australia.

Nothing in this section limits any rights you may have under applicable Australian consumer protection legislation.
